Okay, picture yourself in the chair at the eye doctor’s office. She puts that huge goofy looking machine thingy in front of your face and says, “Is this better or is this better?” “Is number one better or number two?” “Which one is more clear?”
Your estate planning attorney does the same thing, without the goofy machine. Is this better or is this better? Estate planning is counseling based. This means that it is more than filling in the blanks of a form from Legal Zoom or from a stationary store. An estate planning attorney guides you in setting goals and making important choices for you and your family. You make the choices with his guidance and counseling. How else would you know if the forms say what you want them to say? Or, if your estate plan will work?
Estate planning is not a one size fits all by any means. Do you want your children to have easy or somewhat restricted access to the monies you leave them in trust? What if that child has a disability? What if that child has a drug addiction? What if that child is already a millionaire a few times over? What if your spouse is a spendthrift? What if that spouse is a second spouse and not the parent of your children? What happens if you spouse gets remarried? Will your children ever see the money that you worked so hard to provide to them?
